Annex No. 1 to the Public Offer Agreement on the use of software products (online service)

PRIVACY POLICY

General Provisions

To improve the quality of service and security of personal data storage for all Visitors of the Site https://night.xxx, we inform you about what data is collected and stored, and for what purpose the Contractor uses it on the website located at: https://night.xxx (hereinafter - the Site). The Site Administration is very attentive to the confidential information of all users who visit the Site. Therefore, based on the requirements of Ukrainian legislation and the Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data, this Privacy Policy (hereinafter - the Policy) has been developed.

Scope of this Policy

This Policy applies to personal data and information collected on the Site. Personal data and information are those that identify the Site Visitor personally, both separately and in combination with other information available to the Contractor. Personal information may include your name, email address, information obtained as a result of making a payment on the Site, which the Site Visitor may provide when using the Site. This Policy does not apply to other resources, links to which may be specified on the Site. The Contractor is not responsible for the privacy policy or content of third-party resources.

Cookies and similar technologies

The Contractor uses cookies. With each visit to the Site, the Contractor may collect information related to the gadgets and devices used by the Site Visitor, networks to which the Site Visitor connects. This also includes the following information: IP address, browser and its version, types of browser plugins, information about the operating system, as well as information about visits, URL routing, services that were viewed or searched for, all download errors, duration of visits to Site pages, etc. Also, information is collected on the Site through the use of various technologies similar to cookies (including various analytical resources).

Information collected through the Site

On the Contractor's site, when the Site Visitor (User) places an order, participates in a promotion, research or otherwise interacts with the Contractor, the latter collects both personal information and general data. Personal information relates to an individual Site Visitor (User) - for example, pseudonym (nickname), email address, phone number, gender, age, photo (avatar), payment data, payment method data, etc. The Contractor receives such data only from persons who provide it consciously and of their own volition. For example, by registering on the Contractor's site, interacting with customer support. The Contractor does not require registration or provision of any information to view the Contractor's Site. To order services, participate in promotions, research or otherwise interact with the Contractor, the Site Visitor must carefully familiarize themselves with the rights and obligations regarding the processing of personal data, which are specified in Art. 8 of the Law of Ukraine "On Personal Data Protection", carefully read this Privacy Policy, and also express their full agreement with its terms. If the Site Visitor does not agree with any of the terms of this Privacy Policy, they may not provide personal information. The Site Visitor can withdraw consent to use personal information at any time. To do this, it is sufficient to send a message by email to the Contractor's address.

Use of Site Visitors' personal information

The Contractor uses the personal information received by the Site for the following purposes:

1. providing information and services according to the Site Visitor's request and needs;
2. ensuring security and preventing any illegal actions and fraud prevention;
3. to increase the efficiency and quality of User service;
4. more effective personalization of site use;
5. providing special offers that may be of interest to Users;
6. providing information on Site usage;
7. improving the work, functionality, design and other conveniences on the Site;
8. improving the services provided by the Contractor;
9. carrying out direct marketing, for example, sending letters, SMS messages, messages through messengers (for example, Viber, Telegram, etc.), push notifications and other messages, including in the Site interface, of an informational and advertising nature, as well as legitimate interests to counter fraudulent actions, including those related to the test period of using the services.

Personal data storage terms

We store and process your data no longer than they are needed to achieve the purposes for which they were collected. Storage periods are determined individually in each specific case and depend on such things as the nature of the data, why they are collected and processed, as well as relevant legal or operational storage needs. Please note that we may also store and use your information if necessary to comply with legal obligations, resolve disputes and enforce our agreements.

After the expiration of the storage period for processing your data, we may generalize or delete data to a level where the User can no longer be identified, and process it exclusively in statistical form. After taking precautionary measures to protect against the risks of re-identification, the data is no longer considered personal, as it does not allow the User to be identified.

Protection of personal data

The Contractor implements all necessary security measures to protect the User's personal data, for example:

• we provide access to data to a limited number of persons and only when necessary;
• we use the secure Hypertext Transfer Protocol Secure (HTTPS) protocol to ensure that the use of the Media Service over the Internet is secure;
• we train our staff on secure data processing;
• to protect against unauthorized access to data, we have applied a firewall, hashing of User passwords, etc.;
• we also regularly create data backups so that we can restore them when needed.

Changes to the Privacy Policy

Site Visitors, by using the Site, accept all the terms of this Privacy Policy and understand that changes may be made to this Policy unilaterally. Changes made to this Policy are mandatory published by the Contractor on the Site.
